Apple says DOJ's e-book proposed settlement is "fundamentally unfair":
Apple has filed a legal memo in a New York federal court, arguing that the Department of Justice’s proposed settlement with three book publishers is unfair. The memo (PDF) was filed Wednesday in the United States District Court for the Southern District of New York. It screams foul because this settlement would effectively re-write its existing contracts with publishers.
In June, the DOJ announced a proposed settlement with Hachette Book Group, HarperCollins Publishers, and Simon & Schuster, but announced that it would be continuing litigation against Apple, Macmillan, and Penguin Group.
This settlement would effectively cancel the publishers’ agreements with Apple and put a two-year prohibition on “entering into new agreements that constrain retailers’ ability to offer discounts or other promotions to consumers to encourage the sale of the publishers’ e-books."
